Ghost Creek, A Great Place to Play The July 4, 1998 issue of Golfweek magazine contains an advertisement about a well-known golf course in Cornelius, Oregon. The golf course is called Ghost Creek and the owners’ claim of policy is that they want people to come and play their golf course. The owners’ use a beautiful picture of the course to entice the reader to come and play the golf course. The advertisement uses claims of both fact and value, to further the claim of policy as well as offering supports and warrants to give credibility to the claim of policy. To further Ghost Creek’s claim of policy in the advertisement, the owners offer many claims of fact. One claim of fact that is offered by the advertisement is that the magazine, Golf Digest, chose Ghost Creek to be the best new public golf course for the year, 1992. Likewise, another credible golf magazine, Golf Magazine, ranked Ghost Creek 13th out of the top 100 one can play for the year, 1998. Furthermore, many very prestigious golf tournaments have been played on Ghost Creek, including the Nike Tour Championship in 1993 and 1994 and also the 1996 United States Amateur Championship, which was won by the great Tiger Woods. These claims of fact, as one can, see are used to further Ghost Creek’s claim of policy, which is to come and play a great championship golf course. Once more to further Ghost Creek’s claim of policy in the advertisement, the owners offer not only claims of fact, but also many claims of value. One claim of value Ghost Creek offers is just the sheer beauty of the golf course, as seen in the picture of the advertisement. This claim of value lets the reader feel as if he or she is there in real life. Another claim of value the golf course offers is that Tiger Woods has played and won a major tournament there, the 1996 U.S. Amateur Championship. This claim of value provides the reader with knowledge that one of the great pros in the game today has played there. Many readers would want to come and play a golf course where one of the best has played and won. Other claims of value that the advertisement entails are how relaxing, still, and quiet it is at Ghost Creek.

Through the environmental scan the research will bring to sight the reasonable advantages of the companies and plans of use in the company structure. Understanding each company creating value and tolerate competitiveness through business strategy will be written out. Measurements the companies use to validate the strategic effectiveness will show the organizations strategies, and the effectiveness of those strategies.The research should propose more knowledge of the environmental image when ready to move through the competitive business worldwide or local structure. With the environmental scan you have to know the purpose of a SWOT analysis. The SWOT will give you a better view of your company and gives you a deeper understanding of an environmental scan. We have to keep in mind companies in the 21st century have changed a lot to companies back in the days.Starting from the structure of the organization itself, how they plan, how they make decision, up until how they doing things but one thing that has not changed is that organizations which perform with an outstanding result never mistreat their planning. Each organization contends with each other to perform better according to others. Looking at this company they really do look after what actions they do. Especially since they are trying to expand Coca Cola. The second company I chose is Sony. I chose Sony because technology is big in today’s day.Competitive Advantage of Sony’s unbelievable rise in the field of electronics is due to their innovation and high technology products. Sony prides itself on its history of â€Å"imagination and innovation† in the business â€Å"How Can Sony Regain Its Competitive Advantage? † (2012). Sony has come a long ways making a product better and better each ti me. From camcorders to re-invigorating the home gaming market, Sony has had a history of achieving a competitive advantage over its competitors through the use of innovation. Sony has used this for years in order to survive and grow.Business Strategy class breaks down into a two-by-two environment that consists of: Cost Leader, Differentiation, Focused Low-Cost, and Focused Difference. For example, if a company has a cost advantage as compared to its competitor, they produce same product at a lower cost and through differentiation they can make higher profits â€Å"How Can Sony Regain Its Competitive Advantage? † (2012). Competition in the customer electronic industry is mainly needy on barriers to entry, patent protection, access to capital, and cost & differentiation advantages.Even though Sony is well known for their products they are not the only ones out there making new technology. Their competitors are giving them a hard time like Microsoft with the x box or companies that make televisions also. Besides losing its ability to innovate, Sony also has been to slow in answering to the shift of market demand â€Å"How Can Sony Regain Its Competitive Advantage? † (2012). Lower-cost manufacturers from South Korea, China and South American companies, are increasingly undercutting Sony making it harder for them to charge a premium for its products.In 2001, Sony went into a combined venture with Swedish telecommunications equipment company Ericsson. There was no stimulus on the part of Sony to create a superior smartphone product which could gather a premium as the Apple iPhone did. If Sony is to recover its competitive advantage, they need to get back to creating innovative products that consumers see as unique and provides value. Consumers have much more choosing power and competition is fierce.

Argumentative Essay: A Change in Education System Essay

The Philippines educational system is undergoing a big change which follows the international educational system. The K-12 system is the system used by the United States and other countries. The K-12 system is started by the Aquino Administration. The government will add two year plus Kindergarten. Many people think that implementing the program in the Philippines will be insignificant and unnecessary but others think that it would improve the country’s educational system and the country as a whole. I agree with the K-12 system that will help students embrace a better quality education and will give them more job opportunities, especially abroad. There are many arguments regarding the K-12 implementation. I have chosen 3 arguments to talk about. First, parents are not financially stabled. Money would hinder the implementation of the system. The parents would pay two more years for the education of their children. Their children would learn more and gain more knowledge for those additional two year of education. The  money that the parents pay will be put into good use for their children’s future. But the parents would be spending a lot more than they expected for good quality education. The parents are not prepared to pay for two more years of education. The plan of the administration was earlier than expected. And some parents are not happy with this plan because of financial problems. Second, improve the quality education we have in our country. The Philippines need good quality education because we have a poor education system. The K-12 system will help the country to have a higher standard of education the government can add more to the curriculum. The advancement of having an improved quality education would lead to an earlier success in a student’s life. It may take him/ her long to finish high school but he/ she gained more knowledge than the student’s who prepared in 10 years. The student would take longer to finish his/ her basic education but will be more prepared. It is enough that the student is prepared when reaching the age of 18 after finishing the K-12. Their minds will be mature enough to think better than what is expected of them if graduated at the age of 16. Lastly, prepare the student for work after graduating. Not all students who graduated will automatically be sent to a university for college. Some students prepare themselves to look for a job for the sake of having money to study in college while some are forced to work for the sake of helping the family. The students who have accomplished the 12 year system will automatically be recognized professionals because we are following the international education standard. This will be good for our country. But, the student has not accomplished his/ her schooling. He/ she needs to be sent off to college because completing all levels of education would mean a better job in or out of the country. A student can earn more if he/ she finishes college and finds a good job. Based on the arguments stated, either good or bad, the K-12 system has a good point. I agree that the parents will spend more money for good education but their money won’t be put into waste. Their children will experience good quality education that will good for their future. Of course  parents want what’s best for their children in the quality of education because one day, their children will be the ones assisting them when they grow old. The old education system is done for 10 years and it can stress a student’s life if the system should have been 12 years. We all know that some people have financial problems that they go to work after high school. 12 years is longer than the 10 year system but the graduate students of the K-12 will automatically be recognized professionals because we are following the international education standard. The K-12 system will help students get a better job abroad because of the quality education that follows the international education standard.

A Discussion on Moral Issues of Cosmetic Surgery Cosmetic Surgery Cosmetic surgery is a surgical procedure that is done on body parts that are healthy, and has the purpose of improving appearance. Cosmetic surgery has become more common over the years, especially in the United States. However, many are bringing to attention ethical problems related to the increasing percentage of people who have undergone this procedure. While some critics make a few good points about moral issues of cosmetic surgery, many who bring up the ethical issues of the procedure do not make strong enough arguments. Just like any other surgery, cosmetic surgery is a procedure that comes with many risks, but it is still an important one that should continue to be taught to and performed by physicians. Stephen Coleman writes a great defensive argument for cosmetic surgery in his â€Å"A Defense of Cosmetic Surgery†, which specifically excludes reconstructive surgery. Coleman makes an accurate point by stating that cosmetic surgery can be morally justifiable for actors and actresses because the want for these surgeries are based off of their desire to sustain their jobs. (176) People on television are often critiqued on their physical appearance, and this can skew the hiring process for actresses and actors to role in movies and television shows. This especially affects women in the Hollywood industry. Women are strongly pressured to have certain physical features, and to display those features while playing their roles for media. This leads many actresses, female singers, and female models to undergo breast augmentation, breast reduction, abdominoplasty, and many other cosmetic surgeries to look appealing for the general audience and for directors to hire them for media role s. Even though it is sexist and unfair to hire women solely based on their looks, it is the reality of the world we live in today and many women in the media industry are forced to look a certain way to keep their jobs. This suggestion that is reasonable for women in Hollywood to undergo cosmetic surgery can be further expanded to any person looking for a job, seeking a job, or looking to get a better job. Several studies have come to the conclusion that attractive people are more likely to be get call backs for job interviews, get promoted, and get paid more compared to unattractive people. While attractiveness can be seen as subjective, there are certain beauty standards that people are held to such as facial symmetry, a youthful appearance, and large sexual body parts. Since having certain physical features would make a person more successful in terms of careers, it would be ethical for a person to seek to attain those features. However, not every person who wants cosmetic surgery is doing so to have a successful career. As Coleman states in his argument, many of the first plastic surgeons performed plastic surgeries to alleviate problems that other people had on a person’s appearance. He gives a great example saying that many Jewish, Black, and Asian people underwent the surgery to avoid prejudice. These minorities had cosmetic surgery done in order to fight against stereotypes and to conform to the standards of beauty at that time. (Coleman 177). However, Coleman is not seeking to defend these types of surgeries. I disagree with Coleman when he states that surgeries of these circumstances do not fit his definition of cosmetic surgery. Coleman states that surgeries that are performed to relieve serve psychological stress, decrease functional disturbances, and increase physical appearance outside a normal variation should really be considered reconstructive surgery. (173) I argue that surgeries performed to have a more successful career and to decrease stereotypical features of a certain race are definitely cosmetic. They are not medically necessary and some are only performed to fit within Caucasian physical appearance norms, which should not be the standard of attractiveness. Despite my disagreement with Coleman on these issues, I agree with his main argument, which brings the topic of autonomy into the picture. Coleman argues that since autonomy is a basic human right, then people should be allowed to get surgery solely for the purpose of increasing their physical appearance. It would be unethical to shame people into not getting cosmetic surgery or to ban cosmetic surgery. This would be a violation of patient autonomy. Even though there may be risks associated with cosmetic surgeries, just like any other surgery, it does not cause any direct harm. Therefore it could also be argued that beneficence is also a factor that could come to play, because cosmetic surgery increases physical appearance and does not inflict intentional harm. (Coleman 178-180). While Coleman makes the argument that cosmetic surgery is ethical because it respects patient autonomy, Franklin Miller suggests patient sovereignty is a topic that should as be discussed in regards to cosmetic surgery. Miller argues that some physicians and medical companies promote cosmetic surgeries by planting subliminal messages in advertisements for men and women by suggesting that they would look better if they undergo cosmetic surgery. He argues that the field of cosmetic surgery is more business than it is medical. While Miller does raise good points, I believe that these advertisements do not increase the likelihood of people undergoing cosmetic surgeries. Miller suggests that physicians are planting the idea in people’s minds that their bodies should be modified. (Miller 355) However, people are fed these ideas everyday. From actresses to models, people are constantly shown what makes someone physically attractive. People always look up to those in the media, and wa nt to look like those actresses and models. Therefore it would not be accurate in suggesting that physicians are the ones planting these new ideas that our bodies are not perfect. Many physicians are capitalizing on Hollywood’s portrayal of perfect looking people, but it is not an idea that they made themselves. I also argue that not all cosmetic surgeons are doing their jobs simply for the money. Many physicians perform cosmetic surgeries because they actually care about the well being of people and want to help patients in whatever way they can. If a patient would feel better in undergoing cosmetic surgery, then it would be ethical for a doctor to perform the surgery. Also, if one were not thinking about getting cosmetic surgery, advertisements would not suddenly make them believe that they would need the surgery. Advertisements for cosmetic surgeries simply make it more accessible for those seeking to get the surgery. Overall cosmetic surgery should not be an ethical problem. The two main ethical theories that are upheld through cosmetic surgery are nonmaleficence and autonomy. Physicians are doing no harm to the patients that they perform the surgery on, and performing the surgery would be respecting patients’ autonomy for those who want to enhance their physical appearance. Cosmetic surgeries are also beneficial because they can increase one’s self-esteem, increase likelihood of a successful career, and can help people avoid discrimination due to physical features, thereby avoiding psychological harm. In conclusion, cosmetic surgery is a procedure that should be treated like any other surgery, as it causes no direct or intentional harm, and can increase the overall mental health of a patient.

The background foundations for the criminal trial also ensures that the defendant’s right to a fair trial is protected and that he or she has an opportunity to counter the evidence presented against him or her. The foundation for the three-stage trial process in the presentation of evidence is grounded in Article 6 of the European Convention on Human Rights. The right to a fair trial as enunciated in Article 6 of the European Convention on Human Rights provides the defendant with an inalienable right to confront the witnesses against him at the trial. This is also known as the right to not only confront one’s accusers but the right for one’s accusers to confront the accused person.6 In this regard, at the stage of the trial where the prosecution presents its case, evidence is presented substantiating the allegations against the accused through the direct examination of witnesses for the prosecution.7 At the close of the prosecution’s case, the defendant who has the inalienable right to remain silent may make a submission of no case to answer.8 The right to remain silent is not specifically mentioned in the European Convention on Human rights but has been interpreted by the courts to be a necessary part of the right to a fair trial as provided for in Article 6 of the Convention. In fact it was held in Murray v UK that: the right to remain silent under police questioning and the privilege against... From the research it can be comprehended that the trial itself is concerned with the presentation of evidence relevant to the legal and factual issues before the court. The evidence is either presented or debated throughout the trial pursuant to the laws and rules regulating the presentation and admissibility of evidence. Quite often evidence is relevant but inadmissible and unfortunately, in balancing the scales of justice for both victims and defendants and protecting the accused right to a fair trial, the best evidence may not be presented in the courts. However, it is this balancing exercise that requires that as far as possible, the best evidence is presented and at the end of the day, regardless of the outcome, it is supported by the evidence that was legally and fully presented in the course of the trial. If both sides merely traded evidence that was not subject to cross-examination the tribunal of fact would only be getting one side of the story and thus an incomplete version of events. Therefore, examination-in-chief, cross-examination and re-examination facilitate that telling of a complete version so that a tribunal of fact is in possession of the best available and admissible evidence. The strength of the evidence will be tested and scrutinized during cross-examination. The authenticity of the scrutiny and tests during cross-examination will be tested during re-examination.
